Kalshi Utah injunction bid gets a Nov. 6 hearing, not a quick ruling

The CFTC and the U.S. government asked a federal judge to stop Utah's criminal and civil cases against Kalshi; Judge Robert Shelby set an in-person conference for November 6 instead of ruling at once.

Washington has thrown its weight behind Kalshi in Utah, but the judge is in no hurry. The federal government's Kalshi Utah injunction request asks a court to freeze the state's criminal and civil cases against the prediction market, and on Friday the judge answered with a calendar date rather than an order.

What happened

On October 29 the federal government and the CFTC asked the Salt Lake City federal court for an emergency restraining order followed by a preliminary injunction, RG reported from the docket. It sits inside the lawsuit they filed on October 26 against Utah and Attorney General Derek Brown, which argues federal commodities law preempts state gambling laws for event contracts on CFTC-regulated exchanges.

The proposed order would bar Utah from pursuing criminal or civil enforcement over contracts listed on designated contract markets, stop new subpoenas and require the state to dismiss or stay pending cases, Predictable reported. Attached exhibits include Utah's October 20 civil complaint and the three criminal informations filed on October 28 against KalshiEX, chief executive Tarek Mansour and chief operating officer Luana Lopes Lara.

U.S. District Judge Robert J. Shelby did not grant or deny the request. Instead he called the parties to appear in person at 1 p.m. on Friday, November 6, and gave the government until November 3 to serve Utah and until November 4 to file proof.

Why it matters

Speed is the tell. In Arizona, a federal judge granted the same kind of government request within a day in April, TrueEdge Wire noted, halting a misdemeanor prosecution. Shelby is also the judge who ruled against Kalshi's own preemption suit against Utah in August, so the federal government changed the plaintiff, not the statute.

The stakes are personal as well as commercial: the Utah counts name two executives, which our Utah Kalshi criminal charges story detailed, on top of the state's earlier Utah Kalshi lawsuit seeking to cut off sports and election markets. Kalshi itself is not a party to the federal case.

The criminal case is unusually aggressive. Utah's 14 counts accuse Kalshi of promoting online gambling after an undercover agent bet on sports while in the state, TrueEdge Wire reported; the charges are allegations and no one has been convicted. The federal draft order says the government is likely to win on preemption and would suffer irreparable harm without relief. Shelby's schedule means any Kalshi Utah injunction ruling would come only after the election-week trading peak.

What's next

The next checkpoint is the November 6 conference, three days after the midterms. RG's docket report has the filing details.

If Shelby ultimately grants the Kalshi Utah injunction, states lose their sharpest tool, criminal charges, against federally registered exchanges. A denial would encourage other states to follow Utah's path.

Kalshi also sued Missouri on Friday over a sports-contract crackdown, so the fight is spreading on several fronts at once.
